Terms of Use

These terms and conditions (hereinafter referred to as the “Terms of Use”) set forth the terms and conditions for the use of various services (hereinafter referred to as the “Service”) provided by the Internet service operated by YAC Co. Ltd. The Terms and Conditions shall apply to the Company, salon owners and users of the Service (hereinafter referred to as the “Customer”). Customers are requested to read these terms and conditions carefully before using the Service. 

[Article 1] Content of the Service and Our Role

The Service is a website or application that provides a place where salon owners can smoothly offer and customers can purchase for Japanese cultural experience programs. All offers and guarantees between salon owners and customers are the responsibility of them.

[Article 2] Definition of Terms

  1. “WACOY” refers to the online service.
  2. “Member” refers to a customer or salon owner who has agreed to this Terms of Use and has registered as a member of “WACOY”.
  3. “Salon Owner” means a member who intends to offer Japanese cultural experience programs using this service.
  4. “Applicant” refers to a member who wishes to experience Japanese cultural experience programs using the service.

[Article 3] Agreement to the Terms of Service and Modification of the Terms of Service

  1. Agreement to and Application of the Terms of Service
    The TOS shall apply to all relationships between the member and the Company regarding the use of the service.
  2. Modification of the TOS
    The Company reserves the right to modify the TOS as necessary without Member’s approval.
    After modification of the TOS, the Company shall make it known to the members so that they can confirm the modification. If a member uses the service after the TOS has been changed, or if the member does not delete his/her user information within two weeks after the TOS has been changed, the member is deemed to have agreed to the changes. The Company shall not be liable for any damages resulting from the revision or modification of the Terms of Service.

[Article 4] Membership Registration

  1. Registration
    Registration is to be made by the person who wishes to become a member, providing accurate information such as name, address, and contact information.
  2. Prohibition of multiple registrations
    Members may not register multiple memberships.
  3. Refusal or cancellation of membership registration
    The Company may refuse to approve a member registration or cancel a member registration in any of the following cases
    – (1) Boryokudan (organized crime groups), Boryokudan members and those who have not been Boryokudan members for 5 years, quasi-organized Boryokudan members, those who belong to Boryokudan-related companies, general assemblymen, etc., social activists, etc., special intelligence violent groups, etc., terrorists, etc., those designated by the Japanese government or foreign governments as subject to economic sanctions (1) A person who is a member of a crime syndicate, a person who is a cohabitant of a crime syndicate, a person who is a member of a crime syndicate, or any other person similar thereto (all of the above are hereinafter collectively referred to as “Anti-Social Forces”)
    – (2) Minors, however, may register if they have obtained the consent of a person with parental authority or a guardian.
    – (3) Any other cases in which the Company deems a member to be unsuitable.

[Article 5] Prohibited Acts by Members

  1. Members shall not engage in the following acts
    – (1) Violate laws, regulations, or these Terms of Use
    – (2) Registering false membership information
    – (3) Loaning a member ID to another person or disclosing information to another person without authorization
    – (4) Other acts that are not suitable for the smooth use of the service.
  2. Prohibition of use of the service
    The Company may prohibit a user who has been subjected to the measures described in this Article from accessing and using the services provided by the Company in the future.
  3. Disclaimer of liability
    The Company shall not be liable for any damage caused by the measures described in this Article.

[Article 6] Cancellation of Membership

  1. Procedure for withdrawal from membership
    A member may withdraw from the membership upon completion of the prescribed procedures and upon our approval.
    However, if there is a reservation or application for a program, the member may not withdraw from membership if the program has not been completed.
    The member shall be able to withdraw from the membership after completing the uncompleted transaction.
  2. Disclaimer of our company
    Our company shall not be liable for any damage caused by the measures in this article.

[Article 7] Handling of Personal Information, etc.

  1. Privacy Policy
    In addition to these Terms of Use, we will handle personal information in accordance with our Privacy Policy.
  2. Agreement to Privacy Policy
    Members are assumed to have agreed to the Privacy Policy before using the service.
  3. Use by Members
    Members may use personal information obtained through the Service within the scope of the use of the Service, and may not use it for any other purpose.
  4. Purpose of use
    The Company may use personal information, etc. obtained by the Company for the purposes specified in each of the following items.
    – (1) Use within the scope necessary for the provision of this service
    – (2) Questionnaires and analysis for service improvement
    – (3) When we deem it necessary to resolve disputes between members
    – (4) When it is necessary to share personal information with our business partners for the smooth operation of the Service
    – (5) When we deem it necessary to disclose the information in accordance with laws and regulations
    – (6) For other purposes as specified in the Privacy Policy.

[Article 8] Cultural Experience Program Service

  1. We provide a place for members to reserve and apply for Japanese cultural experience programs through this web service.
  2. All applications made through the Cultural Experience Program Service shall be made between salon owners and customers, and the Company shall not be a party to such applications.
  3. Obligations of Salon Owners
    Salon owners are obligated to post accurate information at all times. If the Japanese cultural experience program is changed after the information is provided, the Salon Owner must change the information without delay.
    Salon Owner is responsible for promptly resolving any contact, inquiry, claim, or demand from other members at his/her own responsibility.
    If any damage is caused to the company or other members by the program, the salon owner shall compensate for it at his/her own responsibility and expense.
  4. Obligations of the applicant
    The applicant understands that he/she intends to participate in the program at the time of application, and must use the functions of this site to ask any questions that are unclear or need confirmation before making an application.
    The applicant must fully understand that an application made through this website constitutes a legally effective declaration of intent.
    The applicant shall not negotiate or contact the salon owner by any means other than this site.

[Article 9] Intellectual Property Rights

  1. Attribution of Intellectual Property Rights, etc.
    The rights to all materials comprising the Service shall belong to the Company or a third party holding such rights. The user shall not acquire any rights with respect to all materials in the service, and shall not perform any act that infringes on any intellectual property rights, including ownership rights and copyrights, portrait rights, publicity rights, or other rights related to content materials without the permission of the rights holder. The granting of use of the Service under these Terms of Use shall not be construed as a license to use the rights of the Company or any third party that has such rights in relation to the Service.
  2. Use by us
    The photographs, videos, information, etc. submitted by salon owners may be freely used by our company and those designated by our company for the purpose of advertising, operation, research and development, and announcement of this service.
    In addition, businesses, websites, etc. that have entered into a business partnership or consignment contract with us may also freely use such information if we permit them to do so.

[Article 10] Other

Members are obligated to accept any suggestions for smooth resolution of any problems or disputes that may arise between members within the service.

[Article 11] Governing Law and Court of Jurisdiction

The agreement and validity of this service shall be governed by the laws of Japan, and the Tokyo District Court shall be the court of jurisdiction for any disputes arising from this service.
